Examples of Legal Claims against JUUL
A father in New Jersey claims his son became addicted to nicotine shortly after using JUUL to vape. His son soon became ill and, in the middle of September, the father filed a lawsuit against JUUL. He claimed that he was unaware that there was nicotine in the device as well as of the potential harm the product carried with it.
Additionally, three New Jersey teenagers have filed three separate lawsuits against JUUL. One alleges that a boy became addicted to nicotine after beginning to vape when he was only 14. Within his complaint, he states that he is seeking compensation for any and all New Jersey residents that have been harmed by vaping, or that have become addicted to nicotine as a result thereof.
Lawsuits have also been filed in California, New York, Indiana, and Ohio. The suits are similar to those which were filed against big tobacco companies between the 1950s and the early 1990s. Unfortunately, more deaths and injuries linked to e-cigarettes are likely to make the news.
Two other lawsuits brought by teenagers against JUUL claimed damages for becoming addicted to nicotine when they were just minors. While the age limit was set at 21 in early 2018, some states now have an age limit on purchasing vaping products. It was also long after vaping products had already become popular. Another story making headlines around the country is that of North Carolina’s Attorney General, Josh Stein. Stein has filed nine lawsuits against several e-cigarette companies alleging that they unlawfully targeted children. He also claimed the companies were negligent by not requiring an appropriate age limit for purchasing the product.
The companies named in the lawsuits were Beard Vape, Direct eLiquid, Electric Lotus, Electric Tobacconist, Eonsmoke, Juice Man, Tinted Brew, and VapeCo. Prior to filing these lawsuits, Stein also filed a legal claim against JUUL in May of 2019 alleging that the company marketed its product to minors, or specifically teenagers. All of Stein’s lawsuits pointed to the flavors and packaging, marketing strategies on social media targeted to minors, and the lack of adequate age verification at the time of purchase.
