Lawsuit Alleges Disbarred Colorado Doctor Continues Misdiagnosing Multiple Sclerosis In Florida

PALM BEACH GARDENS, Fla. (July 15, 2019) – A lawsuit filed by Domnick Cunningham & Yaffa in Indian River Circuit Court (Case #312019CA000567XXXXXX) alleges Dr. Gary Weiss, M.D. misdiagnosed Michaelyn Law with Multiple Sclerosis and subjected her to almost two years of unnecessary medical treatment and prescription drug cocktails. Dr. Weiss has been sued multiple times for malpractice and fraud in both Florida and in Colorado. According to public records, his medical license was permanently inactivated in 2014 by the Colorado Medical Board and he was barred from reapplying.

Plaintiff Ms. Law, a retired police officer, first went to see Dr. Weiss on August 19, 2015 with complaints of radiating back pain. Dr. Weiss performed a brain MRI and diagnosed Ms. Law with Multiple Sclerosis (MS). For almost two years Ms. Law underwent treatment for MS and suffered severe side effects including seizures, shingles, gaps in memory, anxiety, and the inability to drive or be left alone. During that period, she was so debilitated by MS drugs that her aging parents and her children had to become her primary caregivers. “I missed my son’s high school graduation and my daughter’s track meets for over a year because I was being treated for a disease I didn’t have,” stated Plaintiff Michaelyn Law.

On February 25, 2017, Ms. Law underwent another brain MRI at the University of Miami Hospital. Following the scan, she learned that she did not, in fact, have Multiple Sclerosis, and none of the medications she had been prescribed were necessary or appropriate.

“There were no legions on my brain and no indication that I ever had MS,” stated Ms. Law. “Every time I suggested getting a second opinion, Dr. Weiss discouraged and deterred me. I trusted him because he was my doctor, but had I known of his history, I would have made very different decisions and spared myself two years of misery.”

Domnick Cunningham & Yaffa attorney Nicole Kruegel filed the medical malpractice lawsuit last Friday alleging Dr. Weiss’s treatment fell woefully below the standard of care by failing to order the appropriate testing and inappropriately diagnosing MS. “This lawsuit will reveal a profit-making cycle of misdiagnosis at the expense of patient care and safety. The most egregious part of this entire case is it exposes a terrible flaw in our healthcare system where a doctor can be barred from practicing in one state but allowed to continue preying upon patients in another without ever informing the public,” Kruegel stated after filing the case.
